The Tribunal rendered a decision on a claim when there was still evidence to receive. The male applicant was excluded. The Minister argued his decision should stand as all of the evidence had been heard with respect to his claim. However, the Court set aside the decision noting that the evidence from the final day might have affected the decision in his case as well.
